Yea, my last job was like that. Their organic sales kept going down, and they also had a lead generation department that worked on commissions. So instead of spending more money marketing, or developing a new strategy they kept cutting the comissions in the lead generation part, and "accidentally" letting comissions fall through the cracks. Ended up having like 3/4 of that department leave. They really were fucking retards over there.

In most cases it's not a bad idea, as long as you're dealing with an actual firm and not just a "freelancer" that takes your $3/hour and continues extending your deadline until you give up on them.

State and federal law override any conflicting provisions in the contract. If the $5k is a sign-on bonus, you are supposed to pay it back. If the $5k is a wage, he's not getting that back. I have literally done this 4-5 times. No one ever sues unless its really worth there time. Where I live even if you win you would have to handle the collection yourself by either taking there liabilities/assets or you would send them to collections.
