Because they have a story line that wouldn't make sense if you played as axis soldiers, or maybe it's beccause it's a game mostly for Americans and they don't think it would be a financially safe move to include playing as the enemy killing allied soldiers.

You can barely count the number of games that have an axis-allied campaign on one hand, if at all.

how are you supposed to sneak in the first hit on a guy who outranges you and kites you? He's going to punish your attempts to close the gap, and if you can close the gap and land a grab on him, you need to dish out more close range damage to break even with his ranged spam

Removing the level scaling in Oblivion makes it infinitely better. I love Bethesda RPGS but I don't know what the fuck they were thinking by having all enemies/loot scale to the players level. Takes all incentive out of leveling up.
