Questions to my copyright lawyer:
If the Feds search my house for pirated media and seize all hard drives and other storage media
How do they tell apart pirated games and rightfully paid DRM-free digital downloads?

What if I had downloaded games from digital stores, which have gone out of business.

I have never heard of anyone saying they prefer GOG because they can "loan a copy to a friend".

The reason I prefer GOG over Steam is that, you get a copy of the game, and can then do whatever the fuck you want with it. Want to apply a translation patch to play it in another language? Fine. Want to change all the game sprites to include bouncing boobs? Fine. Want to play it for a few hours while the internet is down? Fine. You're free to screw around with the game files as much as you'd like, with needing to connect to a server to verify that the files you are using are "correct" or that someone else can change them on you without your knowledge.

I am not sure you are 100% correct in your assessment of copyright law, at least in the U.S. You do indeed have a license to download and play the game from the GOG servers (you do not "own" the code itself) and if GOG goes down, then you lose the right to download it. But you do still retain the right to keep and play the digital version you have - that is part of the rights you do retain through the law. Just as an example, people who purchased digital Wii games and digital DSi games did not suddenly lose the right to play those games, and it did not suddenly become illegal to play those games, just because the Wii/DSi store shut down. You can still legally "own" and play such games, even though the digital version you purchased cannot be re-downloaded at all.

This is true. If you don't like DRM, then you have a problem with the software itself. You do not have any right to attempt to get the software for free just because you dislike part of it.
