If that is an actual concern then just get a Ninja 250. It's the best combination of power/fuel efficiency/cost. Average is 65mpg stock and you can push 80mpg easily with the right gearing depending on your environment.

No after market exhaust is "street legal" when it comes to emissions. This is true in both the USA and Europe. It's not enforced very well in the USA. You can roll up to an inspection with a full Yoshi titanium headers racing exhaust and they wont give a shit.

It's basically just a can with a lot of the internal webbing/mesh removed so it's louder. Contrary to what you will read online, the fact is that if it's louder, it's because of increased airflow so you should really consider investing in some kind of tuning device to allow you to control air/fuel mixture.

4. This is pretty much true of all motorcycle brakes without ABS. If you apply them too quickly and haven't had low-speed parking lot practice, you'll lowside at the least.
Insurance bit: Three times as much a year? Compare it to car insurance. It's still cheap.
The old sportbike bit: They should be avoided, but because they might not come with user friendly features like ABS, fuel injection, tandem braking, fuel gauges, whatever. The same applies to old "learner bikes".

If the gearing is standard, it will only do a slight power wheelie under full throttle in 1st. Snapoff-snapon throttle in 1st gear's power range will make it do a bigger wheelie. Clutchups will do a bigger wheelie again.

Ask if mainshaft bearing has been replaced.
Remove seat. Look for milky discharge in airbox.
Check all electrical systems (turns, lights).
Find out last service for:
-Engine oil
-Forks
-Carb (cleaning)
-Valve clearance
-Liquids (coolant, brakes etc).

If you have options, look for >2003 model - more common parts with LC4 enduro models, better forks, better engine, easier to work on etc.
