Larger SD cards in generald add more latency to the system.
Try formatting them with emunand9, there were some optimizations implemented.

Here's the thing, Nintendo hasn't done shit to accounts since the Wii. Now, you can tell me Wii accounts weren't an NNID, and you'd be right, but the fact remains that if they were going to ban people for something that would have set the precedent. There was massive hacking on Smash and MK7 for example, you could install out of region shop WADs and buy shit which was then tied to your Wii account(Something I did like an idiot), and so on. They haven't done anything even to vWii people who do that.

With the 3DS they should have many ways of just banning you. Every time you load up the eShop it submits and checks the tickets titles you have installed so they should be able to just ban you for having stuff that doesn't match your region, they didn't authorize, and so forth. Every time you load up Miiverse it goes through a check of your games to tell which places you can post to as "Own this game". Hell, if you played anything that's not of your region that could be an instant ban.

The thing is, they've never banned anyone for things like this. The only people they seem to ban are legitimate cheaters out to ruin games(See: Splatoon), you get auto-banned on the Pokemon games and only from them if you use obviously hacked Pokemon on battles, and you get banned from Badge Arcade permanently if you mess with the debugger in it. Any other "bans" are for two weeks and that's it.

If Nintendo wanted to ban people for having CFW they'd already be banned.

All bans are brought on by you being a dumbass. All the examples I know of are:

This is specifically a Monster Hunter X problem since it wasn't out anywhere but Japan but it showed other regions when you went online so they got easily banned.

This is a very specific ban though, and I only know of it happening in Fire Emblem Fates where people were taking their JP save with people like Anna unlocked and going online after transferring their save to their US cart.

I think you have to actually try editing values in-game rather than just running NTR, and it was a delayed ban too. I didn't do too much research into this, and all it banned you from was the Badge Arcade itself.

Keep in mind people don't want to lose access to the eShop or their legitimate purchases, so that's why a person doesn't want to lose their NNID since not everyone pirates everything, and most bans are just two weeks anyways so it's no big deal.
