You should look up how these things work. that thing was a piece of abandonware and the morally right thing to do woud have been to release said code under an open-source license for archival and educational purposes, NOT cash in on it.
What do you think Activision does with these things? They throw them into a grinder since it allows them to charge you for a tiny change in a game from prehistory they haven't even made (Starcraft makers all left the company by 2004).

Just because you can't make "intellectual property" enforceable doesn't mean you forfeit revenue. Take, for example, Netflix. Netflix doesn't make money because everyone feels good that they have proper IP rights to stream the content that Netflix has. Netflix makes money because they have an easy service that allows for average users to stream media from a plethora of devices. This is the case of service granting value as opposed to goods. I can easily torrent a the Burn Notice series onto my computer, but it's easier and more immediate for me just to pay Netflix $10/month so that I can see Burn Notice whenever I want, on whatever device and with no hassle along with a multitude of other movies and TV series.

There is no "abandonware" in fact, its just that some companies dont care enough anymore to hunt people uploading files. Even then, some companies like SEGA can actually demand taking down files every now and then. You can never assume that something is "abandonware" just because you say so.
