I need to know if a good game has now got a cancerous new fanbase.

Putting lines like this in a EULA does not overwrite existing laws.

I promise you, in the near future kickstarter will get taken to court and they will get ruled that when people give them money as backers of a product, it is required that said product is delivered or money refunded.

Money is paid in expectation of a certain product. That product was never delivered.

If 5 people could afford to give 10k to yogscast for this, they can probably afford some high powered lawyers.

The name "The Yogscast" was derived from the title letters of a previous World of Warcraft guild named "Ye Olde Goone Squade".[10] "Goons" are members of the Something Awful forums where the guild was originally formed and which most of the Yogscast members are part of. Videos posted on behalf of the guild were referred to as "YOGScasts", with the term "Yogscast" eventually coming to refer specifically to those posted by videographer Brindley

What are the fees?

If a project is successfully funded, Kickstarter applies a 5% fee to the funds collected.

For US-based projects, pledges will be processed by Amazon Payments, while pledges to non-US projects will be processed securely through a third-party payments processor. In either case, these payment processing fees work out to roughly 3-5%.

The simpliest solution for this is to make legally Kickstarter the receiver of the donations and then have Kickstarter fund the project.
This way you avoid all the legal issues that could arise by having multipel investors, and still have the devs be responsable for their projects by binding them with a real contract to Kickstarter.
If they don't deliver, all of the material bought with the funds is re-sold, the devs have no legal obligations of returning the whole amount as long as they didn't spend them on whores or shit, and what's left after covering debts and expenses is returned to the donators.

Meanwhile they just admitted to starting up a new shilling business:

>Hi all,

>In light of the new Space Engineers episode going out we wanted to take the opportunity to speak openly about something new we're doing, YogDiscovery.

>What is YogDiscovery?

>YogDiscovery is our way of encouraging our creators to showcase fantastic indie games that they love so that everyone benefits.

>How does it work?

>Much like an affiliate link, our creators receive a small share of the revenue generated by the measurable increase in sales generated by their coverage. This will often run for a brief period of time after the video has gone live.

>So for example if a game had an extra 10,000 sales in the week after their video, they would see a small percentage of those extra sales.

>Ideally viewers will be encouraged to purchase through the Humble Store rather than Steam, as developers receive a better margin and 10% of revenue goes to charity.

They will shill your indie game for a percentage of the sales.

>Is a creator legally obligated to fulfill the promises of their project?

Yes. Kickstarter's Terms of Use require creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. (This* is what creators see before they launch.) We crafted these terms to create a legal requirement for creators to follow through on their projects, and to give backers a recourse if they don't. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.

*- Pic related. this is originally a hyperlink

There's more stuff about fulfillment, but even Kickstarter acknowledges that people who start projects and then fail to deliver have broken the law.

>>
>>253586021
>Didn't he do another kikestarter for it afterwards?
No. They expanded the scope of the game and got independent funding from other sources to pay for the extras. And decided to make it into two games instead of one so they could use sales from the first part to help fund the second part.

>>
>>253585819
His math is correct though.

They received $567,665 in funding.
Multiply this by .666666 etc
Yogscast kept $378,443.33 while Kickstarter took $189,221.67

They had 13,647 backers.
The refund game is worth $10.
$136,470 in expenses to buy the game at retail price (and they may have very well gotten a discount for buying that many keys)

$378,443.33 - $136,470 = $241, 973.33.

OP rounded the dollar value up, otherwise his answer is correct.

If one of these bigger investors took them to court, they could get a pretty big and pretty landmark lawsuit with little effort, I can guarentee it.

"A bunch of guys came to us, said they'd make a game if we donated money. We donated a lot of money. They made nothing and then gave us packets of bubble-gum as consolation while the owners told us 'this is actually a good thing', your honor."

Alright, so aside from oil barons some of the best people to drain free money from are probably rich white kids. Rich white kids are, more often than not, highly liberal and most likely go on tumblr, thus they are typically SJW or something similar. There's that kickstarter for some black girl to get white privilege which takes advantage of this, but it doesn't have nearly enough steam behind it for whatever reason. Surely there must be a way to guilt-trip these people into donating to some nebulous cause which can never be delivered on, but what is it?

There are three likely options as to why they didn't hire more staff, either:
1) It was a cynical cash in from the start.
2) They don't/didn't have the industry ties needed to hire professionals.
3) They're so neurotic that they felt the need to be able to look over everyone's shoulder and have nothing done without their stuttering approval, and hiring more people would have made the effort involved feel like an actual job.

My money's on 3.

Think of it like an investment. Just because you invest in something, doesn't mean you'll get any return on it.

This is why I rarely put any money into kickstarters.

Always do your research, see what has already been made, are the people making it trustworthy, are the people making it /competent/, do they have past projects and have they been successful, are their goals and idea realistic.

These are all things you should ask yourself before investing in a kickstarter.
>>
>>253588115
It entitles me to call you a whorish, fat, legbeard for supporting it.

And no, of course I didn't follow it after Dina, the game has been ruined forever.
>>
>>253588085
> If not, fuck you, they're not responsible for returning your money

Actually, by kickstarter's own TOS, if they cannot deliver a stated reward, they must provide a refund.
>>
>>253588171
What? You're justifying your lack of understanding of what the terms "donation" and "investment" mean with some oversimplifyed analogy.
>>
The Kickstarter was done (in legal terms) by the third party developer that the project was outsourced to.

That company is now going into administration, so there is no one to sue.

And regardless, two years of development with $500,000 for a six man team is... really not enough money. I doubt they actually got anything out of it (Brindley & co probably managed a decent licensing fee though, if they're not idiots).

I mean; six salaries, rent on an office, workplace insurance, furniture, computers... they never actually had enough money to complete the project, let alone the talent.
>>
So to be straight and honest here; there have been about ten released kickstarter projects that I am incredibly happy were released. I'm sure there are more, but there are 10 games I own that I'm glad exist. Weird, fucked up games that I doubt would have been funded, included an Ice-Pick Lodge game (my game-dev waifu).

Kikestarter is filled with total garbage and all, but I really do like that slim percentage of good that comes out. How would you guys improve something like kikestarter?
>>
Eh, not the worst case around, at least they are still trying to make up for the shit they got into and trying to give the game and bonus, but they should really give the option of the person getting a refund instead

You are donating money to a Kickstarter, and if it falls apart, it falls apart. Your donation was appreciated at the time.

The legal terms when you kickstart something basically have your "backing" as a donation.

Then the project maker has to make a "good faith" attempt to deliver on the project, if it falls through it falls through, as it did here.

They don't even owe the backers a game, but they're doing that to save face.

This is why 90% of kickstarters, if not more, are fucking stupid to back.

>Funding Might Number 9
After Kickstarter's previous numerous scams, after I had heard 8-4, who censored Fire Emblem Awakening, were doing its localization, and also the fact Kamiya told us Inafune was a businessman, I decided against it after admittedly considering it for a moment.

The whole Dina debacle only made me feel like I had dodged a bullet.
>But she didn't change anything
It turned out she didn't, but the way we were lied to and how the entire incident was handled--ding dong bannu and Inafune saying he wouldn't give any refunds like the day before the Kickstarter was over--is terrible PR and they don't deserve any of my money especially after that.

Other than the main guys behind the Ivalice games, literally everyone else on the team exclusively makes mobile games.

This is another Kickstarter blunder waiting to happen and you don't realize it because you see Matsuno's name on it and instantly want to give him your money because you think just because of him and a few other Ivalice developers, the product will be elder god tier. You don't bother to look into the rest of it. So many Kickstarters succeed based on just having a few famous people on board and/or being "IT'S JUST LIKE THAT GAME YOU LOVED AS A KID". And how many deliver?

Don't get me wrong, I love Final Fantasy Tactics, but this almost makes me angry that you're so eager to part with your money for this.

Why are so fucking retards still so behind on the fact that Kickstarter is NOT just an "investment"? Have you never bothered to go to an actual Kickstarter page, where they say "give us $10 and we'll give you the full game and a thank you"? That means YOU ARE BUYING THE FULL GAME AND A THANK YOU. Not only that, have you bothered reading Kickstarter's T&C where they say makers are obligated to uphold their promises, or googled for a few minutes to see there is already precedent in the US for suing the maker of a Kickstarter that falls through?

No. It was a contract. They clearly offered varying products/services for different levels of backing, and failed to deliver those products/services. Breach of contract. Kickstarter makers need to stop this "back us for $50, and you'll receive the full game and a t-shirt!" stuff, because that means it wasn't just a simple donation, there were conditions under which money has changed hands, and if those conditions are broken then there is possibility for legal reprisal.

The way they deal with alcohol in Turkey is they "aren't allowed to drink a single drop". So they stick their finger in and throw a drop on the floor before drinking. They aren't drinking the "single drop", so it's OK.

I tried to warn people about this shit when kickstarter was growing in popularity.

Unlike a typical investment you don't own anything. You're giving someone money so they can develop the product, make shit tons of money and leave you with a shitty Tolkien prize.

If you really want to support projects, invest by typical means. You get the product you want AND you could potentially make money off it;.

How do people still not understand how kickstarter works?
Its the first goddamn thing on their FAQ. It is not an investment. You are DONATING money to a project that you HOPE will be completed. The ONLY thing creators are obligated to give you are backer rewards.
If you were promised the completed product as a backer reward, tough shit, because they aren't, and never were, obligated to finish the project.

The "reward" they mention is not the finished project, its the stuff you get for backing.
For example: "donate at the 15 dollar level get a t-shirt of my super cool game"
If the project falls through, they still owe people those t-shirts, they don't owe anyone the actual game.

>>
>>253608557
Funding a project on kickstarter is basically giving money to a guy saying "guys I promise I'll do this thing and also if I can't do this thing you still get some cool stuff out of it."

Funding a project on Kickstarter that has the finished project as a backer reward is like giving money to a guy saying "guys I DOUBLE promise I'll do this thing also you dont get shit if I can't do this thing."

>Guy says he'll make a thing on kickstarter
>Promises that you'll get the thing if he makes the thing.
>Is under no obligation to make the thing
>He doesn't make the thing.
>You don't get the thing.

Seems pretty simple to me

Although the project normally isn't guaranteed, it is also a reward. Kickstarter requires them to fulfill or refund for all rewards; which in this case includes the finished project. If they weren't promising copies, they could have gotten away with it. That isn't the case anymore.
>>
This is absolutely ridiculous. I paid $60, and all I got were a few shitty pre-releases, and an atroxious poster. I am going to be enfuriated if them giving me one physical promised item is keeping me from getting a refund. They should have fired them in a month since even then there was fuck all progress to the project. Even the idea of ripping off minecraft to such a degree should have been a red falg for them,
