So I fucked up. Came to Germany and accidentally left torrents open for 5minutes. Now I received notice from some law firm Waldorf-Frommer stating that I have to give then 1090 eur. So what should I do? Maybe someone have experience with something similar?
>>
>>696828

they can not prove you actually downloaded it. just say you did not log out and someone used your computer

also op is a fag for not using vpn
>>
>>696828
You should take your bullshit to >>>/g/sqt.

Then die in a fire.
>>
ignore them.
>>
send them a carefully worded reply that your payment carries a 4000 euro processing fee, and that they owe you the balance, to be paid within fourteen days, otherwise the processing fee goes up to 6000 euros.
>>
op
what were the downloads
>>
just pay them, they are layers, they can and will buttfuck you in all sort of ways if you dont.
>>
this is the Website of a german media / Copyright lawfirm seated in cologne adressing your Problem. the link informs specifically about "Abmahnungen" from Waldorf-Frommer
https://www.wbs-law.de/lp/abmahnung-waldorf-frommer/
>>
>>696828
My friend went to Germany for three weeks and downloaded some movies at that time. Basically after returning home the family at germany got the same notice. They just said that he didnt know about the any DL law in Germany and got of with a warning of some sorts...
>>
Just ignore it, they can't prove anything legally. They are phishing, if you answer, you are acknowledging their claims.
>>
>>697772
Ignoring only works if you're going to leave the country forever before they come to collect the money.

Because ignoring is what allows them to demonstrate that you accept the claims, you have to pay by default if you don't defend yourself.

IF you think they can't prove anything, you'll have to appear in court to have that tested. Good luck.
>>
>>696935
Lol this and take a pic for proof
>>
fake and gay
>>
>>697860
excuse me, loling at my post carries a 12000 euro fee! my lawyers will be contacting you shortly.
>>
>>698481
ill laugh even harder then cause if you educated yourself rather than going blind you wont get that message. would you fuck a hooker without a condom?
>>
why does germany have such strict piracy laws?

Also, is it just Germany?
>>
>>696828
just ignore it. thats what everyone does
>>
Thanks to this thread I went and bought a vpn
>>
>>698595
They just have such an efficient and automated process.

The laws are pretty strict elsewhere, but requires a court order to release info of the perp who then needs to be sued. So small-time pirates are generally ignored and the focus is getting rid of torrent trackers.
>>
>>698620
In Germany they also require a court order, but since lawyers can make quite a bit of money from these C&D letters, it's worth it for them. Basically if you acknowledge the C&D you have to pay the lawyer fee and if you don't it will count against you in court when they sue. If they decide to sue.
>>
>>696828
its a civil demand here in the states. it will cost more for them to take you to court than they will make dont pay it OP
>>
>>698686
which they normally never do.

It's more like a "we scare you into paying us money and we are done with you" approach
>>
>>697774
This isn't true...

Op don't listen to this wanna-be lawyer dolt.
>>
>>698913
goob job backing your statement up with facts
>>
I'm having the same troubles as you have.
Get a lawyer who specialised on these things and ignore the burgers who don't know shit about german law. If you won't pay you have to defend yourself.

>>697772
They have your IP adress and who it belongs to. Since it's your internet connection you have to bear the responsibility when shit happens ("Störerhaftung")
>>
>>696828

>>698917
This. Just this.
Defending yourself means paying a lot more money than they want. With a lawyer on your side, you can pull that bill down to 400-500€ (depends on how much the enemy lawyers really want), or you can go to court with your lawyer and successfully win the case, without paying anything to the enemy lawyers (50% chance, as my lawyer stated).

>>698794
They use this aggressive tone towards the accused 'pirates', to scare them indeed. One should not take the letters too serious, as they are meant as a trap to pay these 1000€ directly without even thinking of it.
Remembering the RedTube-Case, the lawyer made a lot of money with cheating on the courts in Germany, which shows how advanced Germany is.
>>
>>698917
> Since it's your internet connection you have to bear the responsibility when shit happens
Is this just germany or does it happen in the Us and australia as well?
Could you blame it on your wifi being hacked?
especially when your wifi password is password
>>
>>698945
You can try but more likely than not that'll be considered gross negligence. Which it is, really. And you'd be responsible for that.
>>
>>698962
can it really be gross negligence if its password protected (irregardless of the password being good or not)
Negligence would be more not having a password or having the name of your wifi being your password
>>
>>696998
all answers given here /thread
>>
>>699030
If you choose a weak password for the sole reason of being able to say "but that wasn't me, someone else must've guessed the weakest password on the planet honest guv", do you really think you'd get very far with that in court?
>>
>>698595
France have it too but it’s lame, just don’t use TOP 100 on a download platform. And they also send you a warning email (the one you use with your ISP)
I and several friends have been DL’ing for years without receiving letters.
>>
>>696828
ahahahahha my friend made the same mistake

he downloaded music from the top charts in germany and left his computer on for weeks propably seeding god knows how much

he got so many fucking letters from lawyers it was hillarous (for me not him ofcourse)
>>
>>698962
>Hack FBI
>Leak documents
>Get caught
>Court says its FBI's fault for negligence
>TOP KEK
>>
>>698914
Dude what op described are false claims. There are ton of frauds in germany handing out these type of false claims. Simply ignoring them is the best you can do.
>>
>>699853
That's how it WOULD go if the FBI ever used "password" for any password.
>>
>>696828
This is a scam m8. Tried to pull this shit in America and got exposed. Either they took that shit to another country or some faggot in Germany heard about the money the originals made and tried to get away with it where you're at.
>>

I've never heard of this
>>

Or just go and get a contract with Vodafone.
They seem to care more about your privacy than Telekom or any other provider in Germany, as they do not save the data of the internet accesses owner with their IP.
>>
>>701468
Reference for that? From what I remember about german laws they would be required to record that info for six months or some shit.
>>
>>696828
Who are they representing? The government? The ISP? Just ignore the BS, nobody sues you out of the blue or ur trolling
>>
>>696828
I'd bet the letter looked like a Russian wrote it with dirty English
>>
its a well known scam. do not reply to the letter. i got plenty of these when i was in Germany. i asked some locals about it and they said ignore them. everyone gets them. they count on you to panic and pay up before you have time to think.even got one that had legal netflix purchases on it. i didn't have a mailbox so my landlord had to bring me my mail, he'd always laugh when i got one of these.

it will only get worse if you reply. nothing, i repeat nothing will happen if you ignore it. no one will knock on your door. the polizei won't track you down.

>>701477
http://www.dr-wachs.de/blog/2015/04/23/filesharing-immer-noch-am-besten-bei-vodafone/

The year 2016 is still young, and I could not find any other more recent article. Don't know if that changed by now, but I doubt that it did.
Also, iirc, this lawyer Solmecke did a video saying that if the DSL-line is leased by Vodafone, but owned by the Telekom, the IP-addresses are more difficult to be tracked down.

Even though Vodafone might not save IPs and whatnot, it's always a little more secure to download those things with a VPN you are sure you might get problems without a VPN...

>>701871
They are representing several movie studios, and are tracking many torrents mainly with German content.
https://www.waldorf-frommer.de/mandanten.html

Plus they are writing the whole thing that scary to make you pay immediately. Fucking kikes.
>>
>>701912
Dont worry about it, the law does not have the capacity for a studio(s) to charge a user who downloads if the claim was real, its a definate scam
>>
>>701923
I can't tell exactly what point you're trying to make here, but obviously studios DO have the legal right to sue for damages for copyright violations. And they can hire lawyers to do this for them, which is what's happening here.

This. I remember how they tried to get rid of OpenBitTorrent and publicbt. At least it worked for PublicBT... Though OpenBitTorrent does not seem to work lately.

Same thing with Coppersurfer.tk, which received a takeedown notice by the notorious Hollywood-cocksucking anti-piracy company BREIN.
Sad thing is that the admin of Coppersurfer moved all things to German servers :^)

>>703366
Most lawyers are plebs anyway.
>>
>>696828

In the USA, you can torrent anything as long as you don't upload or sell it back as your own content.

The blame should be on the content producers for not inventing a bootleg proof method of distributing content.

It's also the government's fault for not making good enough jobs or satiating its citizens with benefits and a proper education to prevent them from torrenting in the first place.

It's also the universes fault for producing homo sapiens that enjoy downloading free shit. Blame molecular evolution.
>>
>>709062
>torrent anything as long as you don't upload
anon, when you torrent something you ALWAYS upload it at the same time, that's how torrents work
>>
In the event you're not trolling.

What you received is phishing.
Since when can a law firm pronounce a sentence? A real sanction would come through a government department.
>>
You may be trolling us, but if you're not don't pay the spam.
>>
>>710565
Reminder: This is a case in Germany, not in the USA.
If you think that the laws of the USA are the laws of the whole world, then you do have some serious problems.
>>
>>710565
It's not a sentence, it's a C&D. You do have those in your backwards country, yes?

The money demand is to cover lawyer fees and fines, which have to be paid by the recipient of a C&D if it is valid. And if it's valid and he doesn't pay, they have grounds for a lawsuit. If it's not valid and he pays, he's an idiot. If it's not valid and he doesn't pay, they also have grounds for a lawsuit which he has to win to not pay anything.

But because these kinds of lawsuits are frequently very expensive, they are still fishing for people afraid of defending themselves who will pay regardless of merit.
>>

for a second I thought you wanted to say liars, but now I figured it's lawyers.

Just how enforced is torrenting in Germany?

It feels like some Gestapo-level offense.

Enforced torrenting? Like you go to jail if you don't torrent? WTF are you on.

Also torrenting isn't illegal either. Maybe you should rephrase your question in a way that doesn't show your hurp.

>>
>>712540
Too bad, I was just starting to have fun.

Not like this is a quality thread anyway, I don't even know why it's still around.
>>
>>712449
This.
Torrenting is legal. In my history so far I downloaded Terabytes with my shit-tier internet (which is usual for Germany), got like 4 notices for some stupid-ass movies and a game, because the DLCs were not available in Germany. (Note: one offense against me was invalid, due to the fact that I did not participated in that particular torrent).
However, back then I did not know about VPNs, and I was a fool at torrenting.
Today, I download even more over BitTorrent, because of VPN and fuck you lawyers.

Seeding is not the same thing as uploading files. The file uploader is the first person who shares the file to everyone else. Later, that same file can get torrented by a bunch of people who seed it. Let me try to make an analogy with diseases. If you introduce a virus or bacterion to a place where it had never previously been, you are the "uploader". Everyone else can get the same disease (i.e. torrent) and spread it around, but they're just "seeders". They're not the ones who are guilty of having the disease. They just so happened to have caught it.
>>
stupid question time. Is there any possible way you could get in trouble for torrenting in the US? It seems unheard of to me.
>>
>>696828
sounds like bs. if its real they will eventually come to get their money, until then assume its bs. If you end up in court for it say, I thought it was bs.
>>
>>713316
You're safe downloading any kind of stuff you like to torrent in the US.
>>
>>701477
Nah it's an EU wide law that protects privacy as a human right. However, I know in Britain they passed an emergency law that went against the EUs ruling, enforcing all British ISPs to log Internet use. Could be the same in Germany?

>>
>>713373
Germany began to save specific data recently, at least they passed the bill.
ISPs in Germany are forced to save the data for at least 10 weeks, but I am not sure if that applies for cases containing copyright infringements in peer-to-peer, or just googling on how to build a proper bomb on some jihadi website.
Privacy is a good nearly nobody has nowadays anyway.

And to all amerifags and non-Germans:
German laws are different than yours. Don't believe me? Google it, and educate yourself out of your shelter.

Bullshit you can legaly pirate movies, ebooks in poland you just can't seed them.
Some polish movie companies can go after you but i haven't heard about anyone who had to pay for pirating in poland.
Pirating software and games is prohibited but nobody will go after you unless you just dlc stuff without seeding.

If you're genuinely invested in the expectation of reasonable behavior anywhere on 4chan, you're going to have a bad time, man. Also, stop shitting on getcheckedsexuals, cis scum. (kidding, though it's sad I have to point it out)

Also, if you're concerned about maintaining the quality of /t/, stop posting on ancient shitty threads just like the people you're belittling or you become just as guilty of keeping junk on the catalog as they are.

And yes, I understand that this post would make me me a hypocrite, but I really don't care about the quality of anything on this cespool of a site, so the standard doesn't particularly apply.

Was in Germany recently, so it was briefly a very relevant topic.

German law firms send these torrent Abmahnungen out en-masse. It's an easy way to squeeze money out of people without doing any real work.

The number quoted on the letter is a scare. Don't pay the sum quoted, and don't sign their admission of guilt shit. There are Abmahnung lawyers who make similarly quick bucks either writing a no-guilt promise to desist, or they can take it to court and argue it down if WF want to be massive cunts. Waldorf-Frommer sends out such massive numbers of exhorbitant extortionary letters that the courts have even recognised it as a problem, and really cut the numbers down to 150 EUR in some cases, even if you lose.

Chances are they'll back down after the "Yeah, I'm not admitting that I intentionally seeded torrents, but it won't happen again. If you don't like it, fucking sue me" letter. Chances are they're likely to drag you to court if you ignore it, as ignoring the letter makes you look guilty.

Sorry, Anon. First thing I did when I arrived was get a VPN.

The Problem with Waldorf Frommer is, they only send those things out, when they actually logged your IP adress uploading something, meaning they have at least proof that it was your PC.
