Well, in 1991 there was a legal case (VAT Tribunal case LON/91/0160 (United Biscuits) to determine whether jaffa cakes are cakes or biscuits (for tax purposes). It was decided that jaffa cakes are cakes and not biscuits because they go hard when they go stale like cakes, whereas biscuits go soft.
