You have asserted more than once that the bikers had a duty to retreat. I agree it was not smart of them to stop but that doesn't mean that it was illegal for them to stop. The police would have likely taken all of that into account well before even considering charges against the bikers. They don't just charge you the second they have a shooting. They have to take all of the evidence into consideration and then determine what if anything in the situation is prosecutable. He probably would have been smart to lawyer up just to prevent himself from doing or saying anything stupid that might have hindered his position but I doubt he or any of his friends who had defended him on his behalf would have even seen the inside of a court room.

I notice that A LOT of bikes use the dangerousness of their means of travel against other drivers. A mistake that could cause a fender bender or minor accident in a car can kill a biker so if you make that mistake they act like you just tried to kill them.

That said, that does NOT excuse what any of the other people did. The bikers might have just wanted to discuss the issue, as bad an idea as that is. It's hard to say if courts would rule that they ware instigating. Bikers wont be charged with shit for good reason.
