I mean I can't buy a fucking handgun because it's "may issue" and the paperwork takes hundreds of fucking hours to complete. People also get arrested for traveling with their guns, doesn't that violate FOPA? Man I hate this fucking city. Should I just move? Or sue the city? Or just off myself?
>>
>>34997597
no it's not unconstitutional and for your information all the gun laws there are actually really reasonable. you're just a fucking hillbilly
>>
>>34997597
Income tax is illegal and the court's answer has always been "eh whatever". Mostly because oveeturning it would cost a bazillion dollars to refund and the budget is on drugs as it is.
That's kind of how gun control is.
>>
Just move. They give zero fucks about your life beyond taking your exorbitant taxes and what they can control. Move somewhere reasonable.
>>
>>34997597
Yep, but it's not going anywhere. This is literally one of the only times you can blame 'da joos' and be correct.
>>
>>34997597
Potentially, you'd have to win in court though after precedent of everyone ever losing. Depends on the judges though.

>>34997600
That statement is retarded.
>>
>>34997597
"shall not be infringed" is pretty straightforward. If you have an acre of land covered in concrete and I chip away half a square inch of that concrete, I have infringed on your acre of concrete. Understand?
>>
>>34997599
Are you fucking kidding me? I legally can't own an M1 Garand because you can mount a bayonet on it. Not to mention the 7 round magazine limit. What an arbitrary number! It's absolutely ridiculous. The only way to be accepted for a pistol permit is if you're some celebrity or invested some money in the right politician. It's absolutely bonkers. Yet the city has such a crime rate, and there's no way to defend yourself. It's horrible, and you're crazy if you think it's reasonable.

>>34997602
Yeah I'm considering some place in Pennsylvania.

>>34997605
Hi /pol/. But seriously, it really is the jews.

>>34997614

>>
>>34997597

why do you need a bayonet?
why do you need so many bullets?
the only reason crime is so rampant is because you fucking rednecks come in and rob loot and murder
>>
>>34997623
Yeah, because people in the ghetto stab each other with bayonets all the time.
>>
>>34997628
I'll take the bait. Also, I'm no redneck. You can't get any more Yankee than me.

Go upstate buy what ever you want and just don't tell the NYPD or anyone to be honest anon. Forget trying to get a pistol license without hiring a lawyer for 300 an hour atm and a rifle and shotgun permit is obtainable if you led the life of a boy scout and feel like waiting for a year. If you grew up here like I did you know old New York is dead and were priced out due to hipsters willing to pay ridiculous money for shit and Chinese hordes buying all the property for top dollar cash. Move upstate like I'm doing.

You realize the amendment did not legally pass identical versions in all states and a number of the states don't even have a record of the vote right? It'll never change though and courts simply don't want to talk about it
>>
>>34997618
It's back up to 10 round limit, at least in a ruling for western NY.
>>
>>34997773
doesn't change a damn thing about income taxes being legal, thats constitutional. The fact that the entire amendment is 1 sentence means any variety in what did pass is probly equivalent anyway.
>>
>>34997785
All states must ratify an identical version, and anyway some states don't even have a record of it. The judiciary is literally unwilling to rule, of course it'll never change and it's the same reason the 2A is infringed all the time.
>>
>>34997785
Further, NY's 2A version has stronger than constitutional language with "cannot be infringed".
Still infringed to the balls.
>>
>>34997619

TM was an intelligence asset and a patsy, fyi. Still a murderer though.
>>
>>34997926
its a completely different situation from 2nd amendment infringements. Everyone agreed to the core concept behind the 16th and it's literally impossible to fuck this up.
>The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States
There's nothing in the spirit of this text which would be grounds for an argument against variation. It has one purpose, nobody would argue that people who read something similar but not identical would have a different opinion of the purpose of the amendment.

2A is pretty fucking complex statement with very ambiguous language in it. There's a million arguments you can make about it and there's similar language in lots of state constitutions which are different/stronger/weaker which might also apply/contradict supreme court rulings anyway.

>>34997930
And there may be some time in the future when those laws get thrown out because of their unconstitutionality. It really 100% matters on the cases and judges trying them. If the law says one thing and every single judge disagrees they're never going to rule for that law. To fix new york's legal situation you have to first purge it of new yorkers.
>>
>>34997599
Bait, please do not fall for this
>>
>>34997618
None of this is true.

You can own a M1 Garand.

The laws you are speaking of are for the SAFE Act, which pertains to firearms with removable magazines, which are allowed to have 10 rounds now.

I also have a pistol permit, and I am just an average Joe.

I've never understood the bayonet thing. I mean, just why? It doesn't make the weapon that much more dangerous. You're not going to stand off a couple of squad cars of armed cops because you suddenly have a shitty spear that shoots bullets. It's not going to affect street crime. It just boggles the mind.

New York City is an autonomous socialist dictatorship that flagrantly disobeys the laws of both the State of New York and the United States of America. It is never held accountable for it's crimes against the State and the People. The entire city government should be arrested and prosecuted for high crimes and sedition.

Move to Pennsylvania. Hell, even moving upstate gives you an incredible amount of freedoms you don't have in that Communist shithole.
>>
Yes, they're clearly unconstitutional. Recent SCOTUS case law is unambiguous about this.

So just ignore the law, carry, and if you get caught cough up a a million dollars to litigate it.
>>
>>34997599
This is why you don't trust anything on 4chan.
>>
>>34997946
There has never been a literal solution to the Benson arguments, the rest is trash though.

The 2A is not vague or ambiguous. That's retarded.
>>
>>34997597
Every law that restricts purchasing and owning a gun or gun related item is a direct infringement yes. Liberals confuse the point though.

Gun advocates say the second amendment means I can own whatever gun I like with whatever attachments I like because it is clearly defined in our bill of rights

Faggots say "as long as you are able to (eventually) come into ownership of a gun (within the approved premises(your home)) no right is being infringed upon you school shooter

Inb4 some butthurt libshit seeks to reinforce that /k/ is a lefty board, /k/ is politically neutral with a focus on gun advocacy for obvious reasons
>>
>>34999678
Like every other word of it is ambiguous in terms of meaning then and meaning legally after some centuries of legal precedents. Grammatically no it's perfectly simple though which interpretation is actually required to be followed is not.
>>
>>34997597
What's the point of a stock like that? I get that pistol grips are banned in certain states, but surely going back to traditional stocks with straight or semi grips would be better than an abomination like that.
>>
>>35001023
Not literally following the original meaning of the text is at best a disgusting politicized judiciary toxic to the people, at worst it is the crime of Conspiracy Against Rights.
>>
>>35001205
Those judges are empowered to define the law while you are not. Consider that you might have larger problems than petty internet bickering. Not sure if conspiracy against rights is a crime, conspiracy to commit deprevation of rights under color of law....? Probly closer except like, they are the law. Gonna take either replacing the judges or replacing their source of authority to get that settled.
>>
>>35001127
It's a way to put a comb stock on a standard AR lower, for states that ban pistol and thumbhole stocks. If you have a better idea on how to do it, please, share it.
>>
Most of NY city and state laws are unconstitutional. Come to Texas when the rain stops. You can even shoot people in your yard for no reason if the sun has set.
>>
>>35001238
It is absolutely a crime. Simply because a politicized judiciary rules extralegally, does not make it the literally correct interpretation. It means those of means are abusing the people... to a degree or another. What is to be done about it? Vote smart, befriend and persuade others, write to a general audience, and hope.
We're grains of sand, but sand buried empires.
Not one step back.
>>
>>35001341
It's not extralegal it's the defined system of legality. Voting can't change shit because judges aren't voted in. Your rights however are extralegal and that means a bad time for anyone conflicting with the law over them.
>>
>>34997618
PA here, stay the fuck out you goddamn wanker. Every time one of you cunts tries to come here you say "but I'm one of the good ones" and then your antigun friends/family come with you and cancel out your fucking vote. You wanna fix NYC gun laws? Start by fixing the people around you.

DON'T FUCKING BRING THEM HERE DIE IN A FIRE
>>
>>35001289
There's a reason. The sun was down.
>>
>>35001401
We vote for those who appoint. We vote for lower judges as well. Without hope we are nothing, but no one can take hope. You can lie in your blood taking last breath and keep your hope.
It all depends, do you surrender your time? May it never come down to there being more of is than them, but it's still a truth.
Why do you volunteer your hope?
>>
>>34997597
Whatever you do, make sure to throw some support/shekels at that 2nd amendment federal supremacy bill that Rep. Chris Collins is putting together. Basically says no rifles and shotguns (and components like magazines or stocks) can be regulated except on the federal level which would literally anally annihilate all state and local level gun control in one swoop instead of a thousand lawsuits that try to partially fight each little law with the same federal authority.

This shit could be huge especially if suprresors somehow got legalized and maybe even the full auto ban gets targetted for repeal/lawsuit.

I'm talking at least several years down the pipeline however and the lib states will fight tooth and nail until they finally give up come election time for that moderate vote.
>>
>>34997597
It's the supreme court that determines what is constitutional and what isn't, and they tend not to take controversial cases unless on side has a huge amount of support. So, if ever one but new york felt it was unconstitutional it's AWB work be over turned quickly, while if everyone but say, Texas, had an AWB, the second amendment would be deemed unconstitutional.
>>
>>35001479
Oh, I don't have much faith in governments respecting rights. Plenty of hope that they'll collapse under their own weight though. I think the states are the only hope for overpowering federal laws. Feds can't exist without the states supporting or extending their naturally rights-crushing agenda. New York is again probably a lost cause because of all the new yorkers there. Other places are already creating laws which directly conflict with federal ones and the feds can't win that fight.
