Said to some anon in a previous thread that I would read a little on the matter and post my opinion. Since it 404'd here it goes.

One was the knowledge of the person in question and the other was the intention of profiting from such activity. Anyway the ECJ ruled that the issue should be analysed in a casual basis. But in abstract if you were profiting and were posting notorious copyrighted works than indeed you were "were communicating it to the public". The Kodi ruling was rather predictable if you know this previous ruling and in my opinion it changes nothing. Distributing fully loaded kodi boxes constitutes. communication to the public.

We will have a ruling regarding the blocking of thepiratebay sooner or later. I believe the ECJ will decide that it can be blocked. Keep in mind that can and have are different things. I do not agree with this position but by knowing the ECJ previous rulings and the number of countries who block it, it is very probable.

Did Nyaa's situation change? I don't believe it did. They do not stream, they have torrent files and thus the issue is not the same.
What you have to understand is that the ECJ does not send anyone to V& or the like.And most of these cases where of people trying to use EU law to escape the copyright provisions of national law. Well it is not usually efective but if you are a lawyer you try everything.

Well Nyaa is as illegal now as it was before. Private trackers the same. You country's national laws and court rulings are much more important than EU law in this regard. Unfortunately national law is usually worst than UE law regarding copyright. See the UK new legislation, France's ADOPI etc...
