TPP Negotiation: Japan and EUA agree the copyright violation will not be
"offense subject to prosecution only on complaint (from the victim)."
http://www3.nhk.or.jp/news/html/20150211/k10015379371000.html

1. Japan is actually "Jail when victim complain copyright violation."
Obviously, getting yen or not, doujins and fanfictions/fan ilustrations works that way.

2.Japan have no fair-use. There are even a judicial decision what denies the fair-use.
ラストメッセージ in 最終号事件.
It's an decision about the book what makes an collection of "last messages on the last publications".
Authors got guilty.

3. Japan have "Complaint mania", "indictment mania". People what makes complaint/indictment for fun and lulz.
They just makes complaint/indictment anything to police like shoting 5 miniguns at same time.

I'm actually seeing tons of japaneses pissed on 2ch right now.
>>
>>121136329
When it become "no need of victim's complain", what happens:

1. Police goes full "Jeff, start the van. We got work to do." by Complaint mania or by thenselves.

2. Asshole mangaka and asshole lawer: "we are getting more money sueing anything than drawing a manga!"

3. Just immagine the America without fair-use.
>>
>>121136339
I don't need to imagine the US.
In my country anybody can sue, not just the victims. Certain lawyers have specialized on this kind of thing and make a lot of money on copyright infringement.

Surprisingly our only hope lies with the fact that most old japanese farmer hate the TPP, and they got pretty strong lobby with LDP.
>>
>>121138136
Japan has never had fair use laws. The doujin scene exists because no IP holders want to commit the PR suicide and sue the people that are actively marketing their work. The doujin culture is their market, so they generally just look the other way as they produce parodies and whatnot, because it effectively sells their franchise for them. It's not codified in positive law, it's just a sort of unspoken agreement.

The new law allows someone who is not the IP holder, and not affiliated with the IP holder to charge someone for breaching copyright law. SO now, even if the IP holder looks the other way because they encourage the doujin community, some jew can come along and sue the doujin circle, harming both the doujin scene and the IP holder at the same time and make a sweet profit off of the inevitable settlement.

It's essentially legislation aimed deliberately at killing off the otaku market.

There are no fair use from the beguinning.

The fair use itself was no needed since copyright infringiment was and still is "offense subject to prosecution only on complaint (from the victim)."
Being connivance is good for companies what don't want to say "OK for fan-things" but don't want to make the fans pissed but it forces the compannies to make rules for fan-productions.

A doujin is anything that is not under a publishing label. It does not need to have a source material.
All of TM's biggest works were originally doujins.
The way this law works is that the accused will be the one responsible to prove his innocence, so you can get faggots trying to bag you on some vague suspicions of IP violation.

Mind you, I'm probably wrong but that's what I picked up.

Either way, it only benefits the mega-corps and not many of the smaller groups who rely on stuff like doujins and fanworks to keep things fresh in the minds of fans.

The government that wants to both destroy the otaku subculture because "muh youth are living their lives incorrectly" and the entirety of japan's non-live action multimedia industry because "we don't understand why people like this, so it's wrong".

The government thinks that killing off this huge multimedia industry will be good for the economy because they don't understand how economy works and have never been able to generate effective economic policy.

Japanese politics are comical. They're a country that's gotten by based largely on massive economic support and trade favouritism by the US and the rest of NATO, and because massive amounts of capital were simply flowing into their country, the government itself has never had any real responsibility to do anything. That bubble burst in the 90's and ever since they've been floundering, unable to let go of the old habit of just doing whatever the fuck they pleased and getting away with it because they were irrelevant to the economy of their own nation.

Japan is the coddled child that is now middle-aged and still doesn't know how to do their own laundry.

It's probably the best marketing tool of the 21st century, which is no doubt distressing to the radical core of the movement who plant their roots firmly in marxist soil.

So it won't even be a matter of media corps protecting their content, but rather it would be a sword used by the government to cut down anything it sees as undesirable. So even if a corp could benefit from fan works, the government could use the new rules anyways.
>>
>>121136329
>I'm actually seeing tons of japaneses pissed on 2ch right now.

I don't get this. Why the fuck would I get money for suing somebody who ripped off somebody else? What's the justification for this? What is this money compensating for? Am I being paid for being a good goy and denouncing the evil of plagiarism?
>>

>So even if a corp could benefit from fan works, the government could use the new rules anyways.
Well they could take a PR-Hit and allow Fanworks to prevent the Goverment from doing that.
>>

When you consider that the animation industry itself is just a smaller appendage of a much larger print industry that services manga, LN's, drama CD's, music and physical merchandise, and that all of these are interwoven , co-dependent and related, it's a pretty damn impressive share of the nation's economy.

And then the government would hamstring this source of income in their already ailing and struggling economic situation because 'muh morals'.

That's so in-character.
>>
>Lots of far superior original books in need of a scan
>Fools from pekingduckburg and sushisland, some even from burgerstan upload tons of doujin instead

Make me happy, tabula rasa this fucking shit. Then, I need one last DMCA from mujin comics and I'm all set, I'll literally throw a party.

Ah, and the doujin market is overrated. The one you think that drives the industry is all non-h and homo. The h/et one, let alone the h one that usually gets uploaded to sadpanda, amounts to fuck-all. People don't buy Amagi dvd because of gook porn, you're fucking delusional.

>>
>>121139747
Yep.
It's like when you find a purse and you bring it to its original owner and they pay you 10%.
In Germany they tried to limit how much you can earn that way to 170 euro per case, but the lawyers got around that by claiming that their personal wage is at some 700 euro which also needs to be paid - by the wrong-doer.
>>
>>121139771
The problem is that as written they can say they allow fanworks, but the government can say "nope" and go ahead with prosecutions. There would have to be a specific licensed permission in order to avoid that.

Yes and no. The government is a third party in one sense, but not really because it is also the controller of the judicial process.

No. They can give out a blanket License. Case closed. Could even be structured in the Way "everyone gets one, but the author reserves the Right to revoke the license if a list of rules is violated".

This way the Prosecutor would have to ask the Author, if it really is Copyright infringement.

(This will not happen. This Rulechange is just a way to fuck over Authors.)

The whistleblower is entitled to part of the payout, as compensation for being a good samaritan, and to help cover the legal fees involved, since they are footing the bill in place of the IP holder.

Only, they aren't actually good samaritans because they're only blowing the whistle so that they can turn a profit off of somebody else's work.

This is one of those cases of the positive law and full law being in contradiction and the conservative legal system failing to evaluate itself objectively.

I have a thought, but it begs the question about the anime/manga industry actually caring about doujin culture and not just being ambivalent towards it. They could literally just license it out to doujin artists under some sort of fair use policy (no royalties for sales under ¥xxxx, original authors need to be credited. Things like that). A doujin artist could just go to the copyright holder's website, fill out a quick form and then they're a license holder and impervious to infringement lawsuits.

It's not always botting, most of the games with point rankings will have both

1. People spamming money to quickly refresh "stamina" and go on continuous runs for more points

2. Special cards, usually very high rares, that have x10 point rate that you can get from gacha with a low rate during that time that has durations ranging from a week to even a month.

But yeah its a brilliant way to scam money out of people every week with new cards, new rankings, new updates. Maybe there are a few bots that are in high rankings, but I'm pretty sure most of them are just people shelling out cash.

Plus they're seeking fast track authority so it doesn't come under legislative scrutiny and debate and have the time and opportunity for the public to get pissed off.

People who try to make bills about the internet don't even use the internet.

They're getting smarter and just hiring more people that are tech-savvy and legal friendly to fight for them before they get "hacked"

>Japan doesn't give a fuck about anything outside its own island
Japan is intensely influenced by western culture.
We are consuming some of the most conservative media. Anime is aimed at people who are shutting out the outside world. You think those are the kind of people who would want new traditions to penetrate their little worlds?
They can't even say goodbye to sailor uniforms.

You were preaching. Maybe not consciously, but you were. Take that somewhere else. SJW are already despised on /a/, there's no need for that.

It would be far better to write something original, using that as a base if you need to, considering that it would make your email stand out amid a sea of identical messages with different signatures.

There's the problem, /a/ is losing ground to SJWs. You probably haven't noticed this, but any and all opposition to SJWs is met with ridicule these days in the form of stale fedora-jokes, or /pol/ boogeyman conspiracy theorist accusations. These fuckers are a genuine threat and people think they're friends.

Not entirely, gawker is known to use moles to infiltrate and adapt to various internet communities. One as big as 4chan is no exception, in fact we're a main target. Only the predominantly male/masculine boards of 4chan haven't been taken so far. /r9k/ in particular went from being "so ronery" to downright fucking marxists.

>Prepare for the manga industry to be the same repetitive unending bullshit ala Marvel/DC crap.
America has very free fair use laws, which have led to the repetitive unending popularity of only a few franchises.
Japan has very restrictive fair use laws, which have led to a very very diverse amount of new characters, and new stories created every single day.

The opposite would happen if the laws got strengthened. People would be even more scared of getting sued and try to create even more outrageous stories.
The restrictions on fair use encourage people to be more creative and start their own story so that one day they may be able to make money off those ideas.

When fair use is free and open it actually hinders creativity because drawing on already popular ideas is more likely to generate income.

>>

>Doujin "artists" are talentless hacks.
You're missing the point.
Save for rare talents or exceptions, pretty much anybody aspiring to becoming a mangaka will make doujins to practise before getting in the assistant crew of another author.

It's not only matter of no more porn or fanfictions: iIf doujins are killed off there will be close to no way for aspiring artists to practice the "real deal" before getting the professional mangaka world.

Japan has harsh punishments. Japan has less overall crime and more bizarre and extreme crime. This is literally nothing new, despite whatever click-baity "doujin scene" subject you want to use.

You are retarded.

1) You can't outlaw cliches.
2) Everybody's doing it. Not just Japan.
3) Manga is very diverse. If the west were interested in anything but the most cliched stuff, then we'd get a lot more variety. That includes doujinshi.
>>
>>121143282
Japan only has a low "crime rate" because the statistics are utterly baked. Japanese police in many places don't even bother making arrests unless they're sure to get a conviction, for example.

More teeth and judicial standing for over-forceful enforcement. Treaties supersede state and federal law, though not the Constitution.
