Imagine if someone actually managed to magic a person to death. How would that be tried in a court of law seeing as magic is not possible according to mainstream science? You can have hundreds of witnesses saying you neutralized someone by shooting lightening bolts at them and no one can prove it because "magic isn't real".

Magic don't work that way, it's invisible and will appear "natural" every time. This is why its practice was illegal during certain times in history, you can get away with anything if you use magic. Unless of course you mess with another wizard or group of them.

Today this is the invisible war noone knows about. You can see the casualties but unless you know what is going on you can't understand it's a war.

First and foremost, if you think a civilian bringing up a lawsuit ever does ANY work to convict the person they're suing, you're fucking incorrect. The legal system in the United States was created as a business to get convictions, so they're incredibly good at it. The case would result in you mentioning pink sparks once, then no one taking you seriously as your prosecutor convicts the fuck out of this guy for dog murder.

That said, magical courts exist, but there are too many groups with differing laws and policies to say anything more than police your coven/circle. And don't do magic alone unless you're told often that you're a good person by mundane people.

The prosecutor would have to prove beyond a shadow of a doubt, which is defined as 95-99% certainty, that the guy killed your dog. Without some kind of outside evidence, conviction is impossible. However, the method he used is irrelevant. If you could somehow prove that he used magic to kill your dog, like with eyewitness testimony, he would be charged with the crime all the same.
