Nah there's quite a lot on there for which copyright holders exist. They have Disney titles even. They're just things that haven't been touched in so long people hope they probably won't care.

They actually don't have the Disney games downloadable, just listed for info. But they do have ones from other companies that are still around like Sega, probably because Sega's generally been cool about it.

No, abandonwares aren't legal.

Also, most of "abandonware" games on sites just aren't even real "abandonware", it's just an excuse to feel better about piracy. What I mean is, IPs and rights shift when a dev/publisher dies, don't tell them they KNOW where those rights are for every single game. Besides every abandonware site has games which are still being sold.

Does it count if the creator said he would rather you just pirate his old games like Psychonaughts and Grim Fandango and then buy a T-shirt to support the company?

I would far rather do that then pay a reseller for a used copy of something.
