The rights to the MOVIES go to Fox. Marvel owns the rights to the original comics and, more importantly to this discussion, the games. However, they refuse to allow the X-Men or FF into the games just to spite Fox and prevent them from getting publicity. They gutted the cast of MVC:I for the sake of spiting a different company.
