Apparantly it's a high chance that the new version of freeshop is causing this. This is because the new version of it sends packet data to Nintendo letting them know who is downloading what. According to 1 anon they are trying to go full damage control in their discord.
Some people have reported that them using the old version of freeshop banned them but it could just have auto updated.

Maybe verlisify isn't wrong about this? I mean, yeah hacking can be harmless if you're hacking for solo play (which you don't need WiFi services for anyway) but it does legitimate damage to the competitive community by removing a very small barrier to entry (the effort to actually breed/soft reset and train the mon) and allowing anyone to get in and diminishing the communities quality.

Despite having cfw, I play original carts. I was playing with my original Pokemon cartridge online yesterday. After leaving the online mode, instead of turning it off, I closed my 3ds (kept it suspended). I read about the bans last night but I was too sleepy and scared to check. I opened it again today while in game, went online, all normal, no problems with gl either. I'm scared to leave the game, turn my 3ds off and then open again.

I hacked my 3DS to play games that were never getting localized, namely Dragon Quest Monsters. I still buy the carts for games that I want that come stateside because I like supporting the developers when that option is available. I even still pay for Pokebank despite how fucking useless that is when I could just transfer everything to the homebrew version.
