Fanmade game is still a full game. It would normally fall under fair use, but Nintendo is just being a bitch with those.

-Showdown is open source which makes it 10000x harder to remove from the internet

I imagine there have been several meetings at TPCI regarding the effect of Battle Simulators on their sales that have come to the conclusion that removing it would cause more drama with the community and alienate dedicated fans, many of whom are the type to buy lots of extra merch, which is where they get a huge portion of money.

Not surprised. I think Masuda knows about Prism and didn't seem to mind at all. Nintendo is what I believe everyone needs to watch out for.

Their own country's fanbase not playing it probably has something to do with it. I don't think they quite understand how much impact showdown has in the west.

It's pretty stupid that fan games like Prism get taken down but a game that literally copies the battles of the real games is free to do what it wants

You have no idea how fair use works. Bulbaped would probably fall under it but there's little argument that showdown does and not a very good one with fangames

Even just reading the Wikipedia article on fair use would tell you that, you should do it sometime. I think both SHOULD fall under it, but they almost certainly wouldn't outside of specific cirumcstances for the latter
