Well they aren't really lying, some areas are in fact playable in 3D.
It's just exclusively limited to the pokefinder.
The game is far to ambitious and large for the 3DS to be able to handle rendering it in 3D.

Considering they listed the entire game as a 3DS game, the quantity of 3D could be used to claim false advertising and sue them.
