The 3DS stores the hacked game ID of the ROM you downloaded. Since you and all of the other pirates are storing the exact same game ID it's really easy for them to figure out who is playing an illegal version. The moment you use ANY online features on the 3DS, and the "what have I been playing" data syncs, they will know, and they will ban you. How could you possibly think they wouldn't know? BTW they are actively banning accounts, but also the 3DS mac address. So your account as well as your physical 3DS are both banned.

Only physical copies have unique headers, dumbfuck. Eshop versions will all have the same one, so they can't tell a pirated one from a legitimate one.
