Probably because empty cartriges are massively produced this way, and the game is written onto them along with applying the sticker much later in the process. Manufacturing a different colored cartridge specially for one game would be a waste of time and money.

In 3DS rom dumping terminology 'legit' is usually used to refer to games that come preinstalled on consoles, they use a license file that's accepted as legitimate on whatever console it's installed, even without custom firmware. But you're probably right, OP's just one of those idiots that misread SciresM's tweet and thinks that the leaked version isn't the final retail version.
