Regenerator, Merciless is a stupid meme because this thing gets like zero attacking power in the first place.
Mixed defenses, it will depend on the meta where you want to invest to avoid 2hko with rocks and such.

63 Atk and 53 Sp. Atk are very low for a fully evolved Pokémon, and paired with Toxic from a Poison-type, Merciless is an ability that must not be overlooked.
Also OP, HP and either Def or Sp. Def because both stats are the same but Sp. Def is 10 points lower than Def.

Regenerator, some people will run merciless but it's pretty much a meme.
Max HP, mixed def/sdef depending on what threats you need it to check, this is a pokemon that will reward you for doing lots of calcs

Merciless. Toxapex has access to two recovering moves, no need to give it Regenerator. Merciless helps it deal SOME damage, which is always welcomed.

In game, no reason not to go Merciless. Mericless Toxic + Venoshock wrecks anything that's not immune.
Competitive? Regenerator, no contest. Sets will 100% be defensive, and look a lot like >>29907173 with variations depending on meta and whatnot.

also Toxapex has naturally higher Atk than SpA so with out putting EVs into SpA on the defensive set I prefer to stay physical
This thing is a counterpart to Araquanid, isn't it? I'm almost waiting for some horrifying side effect of Merciless to be uncovered.
