That's not a ROM hack, that was a game built completely from scratch in RPG Maker.

If it were a ROM hack distributed as an IPS patch, Nintendo wouldn't have been able to do anything about it.

Buddy, they can't do anything about an IPS patch. If the creators were distributing it as a full ROM, containing Nintendo's own copyrighted code, they could. But since IPS files only contain the parts that have been changed, they have no legal basis to C&D them. They might try it as a scare tactic but legally there's nothing they can do.

Besides, have we all forgotten that Uranium wasn't even taken down by Nintendo? The creators did it voluntarily after seeing what happened to AM2R.
