You may not have legal documentation, but you'd most likely still be assigned something, based on the system of that culture. Obviously, "legal sex" is what we use in a modern, real context. (And no one's really gotten at the intersex argument other than stating its an anomaly, which doesn't stop it from happening).

For example, in some cultures, everyone is considered one gender. In others, there are three distinct genders.
