Download a file called minvercheck, you can google it. Put it on a USB then do a system update via USB on your PS3 in the settings. The update will give you a error message stating how low your PS3 firmware can go down. If it says 3.55 or lower then you're good.

Go into FBI and find your installed copy of Sun in the 'Titles' folder.
If the version number is 0 then that is the Lurantis leak and might not be safe to go online with.
If the version number is 32 then that is identical the freeshop version and is perfectly safe to go online with.

If you're in Europe then going online is completely unsafe no matter what version you have until the game launches legitimately tomorrow. It's most likely the bans were entirely due to people going online early with the versions mattering little if at all, but I'd say go with the '32' version to be completely safe in safe Nintendo go looking for obvious pirates.

The o3DS method works for both consoles. You just have to be careful on the n3DS after going into 2.1. That's why the OTPless method was created, but there's a rare chance of bricking apparently.
Never happened to me on the 4 different n3DS I've done, but that's not a huge sample size.

downgrading n3ds for a9lh is exactly the same as the o3ds method: downgrade to 9.2 with New 3ds pack, ctrnand transfer to 2.1 using the o3ds pack, then do the rest of the "o3ds" guide
