instant death is usually a bad idea unless you give the player ways to work around it, like FF6's Life 3, immunity items, or skills that can stop an enemy executing an action.
Bullshit that player's have no way of countering is bad game design. It's not challenging, just unfair.
The only exception is insta kills that are provoked from certain conditions, either a single target counter skill, or some special circumstances that is suppose to result in a game over.

That sounds fine to me, though given a choice like that, I think most players would actually choose tojump in and try to help. People typically take the heroic option in games, in my experience, even if the situation is supposed to be hopeless... it's pretty common for RPG heroes to find themselves in overwhelming danger and make it out just fine, I think.
It's quite possible to condition the player to take failure seriously and carefully consider any choices that come up, of course. Just look at Dark Souls.
