You can expand that to literally everything else about the game and it applies. It's a "classic Sonic" game designed by someone who has no clue what a classic Sonic game was like.

And the music was done by Senoue, who did some of the music for Sonic 3 and Sonic & Knuckles so it's definitely a design choice made at the top rather than anything he'd intentionally do.

Everyone said that. About your other points, about the physics, sure, if you're used to certain kind of flow, it somehow fall flat on the floor, but once you get used, you can get fast even in some underwater sections. I'm not talking about wind sections...

A lot of decisions and bad things pointed out are minor flaws and nothing that is game breaking or ruining the game itself, they are flaws that need to be worked on. In short, the main problem is Iizuka being a hack and SEGA execs caring more about deadlines than quality.

The thing is, Ep I was obviously just a mobile cash-in which had nothing to do with being a continuation that they later on decided to stick the 4 on for more bucks. The graphics are cheap. All the levels and enemies are just rip-offs of the Genesis games to make casuals think they're playing a game just like the classic ones. The lack of momentum and presence of the homing attack makes the game better suited to touch screen controls. The special stages are perfect for touch screen/gyroscope controls, too. The game even had/has (I can't remember which) an actual level section to take advantage of a phone's gyroscope. They already had the game and figured it would sell more if they put it on consoles and marketed it as a true sequel to the Genesis games. Ep II was so much better because they were trying to make a classic 2D Sonic game and continuation of the older ones from the beginning, instead of relabeling a cheap mobile game.

Yea, I know. Thing is I just suck at anything other than using my imagination. I can barely draw. Can't get too into scripting and I tried my hand out on modeling using the UE4 and that's also difficult but easier than scripting and drawing.
At least with modeling I can start with a ball and slowly form the shape I want (through needless hours of work.)

So yea, you kinda understand how fucked I am if I just go for game designer/producer. Not only that I heard that the Game Designer market is HIGHLY competitive and is the major reason why Indie exist as a genre.

Ultimately the best I can do is layout my ideas and designs on paper which pretty much anyone can do anyway.

The story could have been executed better via presentation that doesn't make you want to kill yourself, and his theme is actually a lot sadder out of context. As for the story itself, it is pretty sad when you look at it like a written story or something and ignore the actual cutscenes. Also, the way I see it is that Gamma and the bird are two completely different beings, and the bird was only a battery. The bird had no part in controlling anything Gamma did or thought.

No, LW was a weird game to port, not only because of the reception it got or because people were asking for Unleashed longer, but because the game wasn't designed to be scaled back in anyway. It was built as a Wii U game to run at a locked 60fps so they devs never though to themselves "what if someone can't run this well?"
That and the game is actually built around the unpatched Wii U version so a lot of bugs are still in.

LHC is fine. You can claim fair use under educational purposes, especially if it remains just the history of the ideas that were being thrown around at archie. It's protected like video tapes of convention panels where speakers talk about IPs they're not working on anymore and their plans for it.

And since Ian is a freelancer, it insulates Archie even more. It doesn't matter if he's still working for Archie or not (because archie is technically not a party because technically it's a dispute between a copyright holder (Penders) and a single infringer (Ian)), but even if it did matter, his freelancer status insulates archie almost completely, as he's not an "employee" (though there might be room for an analysis similar to a work-for-hire one as to whether someone is an employee or an independent contractor.

Ian might be an infringer, but even if he was, since he wasn't selling it.

And to defeat fair use, you can use the argument about what copyright is supposed to be intended for, which is economic development and continuation of series. Creating sequels and the like. I doubt any court will find that a discussion about possible plans that have been thrown away will infringe on possible sequels to the LSC

The settlement stated that Penders cannot equate his characters to Archie characters, and must make that distinction, right? So if he starts claiming that Ian's actions are infringing on his copyright, he might be tripping over his own two feet and into liability himself. If you're claiming that the old characters are similar enough that even talking about them in the past tense is enough to trip liability, then he might not have differentiated them enough from his new characters....at least, that's a possible argument to counter-sue over if he does go to court.

And before anyone says "Well, Archie needs to avoid going to court, period", sometimes, you just can't. When you get someone like Penders around, it's better for both SEGA and Archie.

Threatening lawsuits wouldn't be given the same deference as the filing of frivolous lawsuits, but there is definitely case law out there that constant threats of impending lawsuits can be damaging enough to warrant a harassment claim. Especially if it makes business difficult to be conducted, and it effects the good name and relationship between a company/person and their fans.

And if he uses legal arguments, and advertises his thought process as such on twitter, that contradict a former settlement, and equate the old characters to the new characters (if that's what's prohibited), Archie can pick up the suit themselves, which would be the contract breach suit (settlements are technically contracts)

There's a lot of ifs, and a lot of this is based off of what we all assume to be in the settlement, but it's definitely not something that Archie or Ian should dismiss out of hand if he comes after them for something.

I also find it hilarious that in trying to do his own thing with LSC, he ties the entire continuity of the book to the comics. So basically the only way for new readers to understand who the characters are and why they should care is to read 10+ year old comics in a franchise they may not care about (and are hard to find) from an entirely different publisher, somehow like what they read, and then read LSC. Otherwise new readers won't know what the fuck is going on, because Penders, for all the exposition he spouts in his stories, doesn't contextualize things well

Do what the comics did and stick him on Team Dark. Shadow is at his most interesting when he's interacting with Rouge and Omega. It was the best part of 06, and Rouge and Shadow definitely have one of the more underexplored but closest relationships in the franchise, and Omega's also great.
