Honestly it's surprising because water is one of the first thing they got right in cgi film, now I really don't know the connection or if there even is one but I assume there's some weight there, like maybe it means water is simple I don't know.
Games can do really well with static "painted" backgrounds though, really look at Halo 3, shit looks good.

Not him but animating fluid is fairly difficult to get right in video games
You can't have everything rendered in real time, that would tank framerates so hard that SLI 1080tis would struggle at 1080p
The alternative is using filters, sprites and textures to emulate splashing effects, which is obviously not going to look great because you're using flat 2D images with no depth to look like they're fluid.

the industry (acadamia, NVIDIA, etc.) is still in the process of fine-tuning real-time water simulations that look good. right now you can do some smaller, simpler simulations that require limiting interactivity/scope, but real-time convincing water with any sort of interesting interactions get really hairy really quickly.

and if i had to guess, they're using a shallow water equation + normal mapping to simulate it. It's a limited simulation, but works really efficiently.

Tesselation essentially gives the illusion of higher poly counts and can help with making small ripples in the water, but not much else. Something being dropped in the water, for example, would need to use sprites for splash effects. Also, tesselation is still quite performance heavy for anything that isn't using a higher-end nvidia card, so not everything can rely on it, especially consoles.
