I don't thin he could sue over something like this. Tengus are some sort of Japanese mythological creature that has existed all throughout its culture since the very beginning. They just both happen to take inspiration from that and ended up making similar characters as a result. I don't think Nyo was inspired from Aya but even if she was you probably couldn't sue for something like inspiration. Zun cant even really do much about those touhou animes floating around that actually do infringe on his copyright.
