They didn't shut down because of marvel or dc, they shut down to make server room for Wildstar.
Marvel did sue way back in the day though, not sure what came of all that.

Was sad seeing this game shut down. Played during beta until about after the shadow spires popped up. Stopped playing it for a while then came back when they added multi-hit weapons. I'd even log on to pay all the maintenance fees for the town my guild owned.

The case was settled out of court, IIRC. As part of the settlement, Cryptic was to develop a Marvel game, but the project fell through.

Meanwhile games like SWG and Warhammer Online had resurrection projects that had significant progress after a few months of servers being shut down.
