Purpose is the same, but functionality is different. The device slips over an android/iphone and uses bluetooth. The joycons SLIDE into the sides of the switch and can be used as separate controllers. It also slides to charge, both entirely different functions than the thing in the OP.

Nintendo must have certainly been aware of this product as they produced the Switch. That means it must have been looked at by their law teams prior to production. And that they must have approved of it, meaning that Nintendo must be confident.

At worst they'll get a fee that Nintendo were fine with paying from the beginning. At best they'll get nothing on Nintendo to begin with.
