Well, yeah it does. The assets that aren't made from scratch by private server owners are clientside, and free to download. The server owners aren't the ones liable, the players are, assuming they agreed to a terms of service agreement. And since primitive versions of the game are exclusively downloaded through third party providers and torrents, they only agree to the ToS that appears in the game itself. If that doesn't cover something (like playing without paying) then the player isn't liable either. It's a bunch of strongarming and that's it.
