Just skimming through it, I didn't see anything like that. But it's a for-profit product taking massive liberties with the Mario brand. I thought the whole point of C&Ds were to defend the IP. Because it definitely needs defense from this shit.

Nintendo sees AM2R, they see the fan reaction to it, and their immediate thought is competition. Whether the creator sells it or not it's competing with a brand, an IP that Nintendo owns. When it comes to video games, if you can make a better game than Nintendo using their brand then you're a threat and you need to be taken out.

With shit like this, they probably don't even pick it up on their radar. Who is even going to read it? It's just some shitty fanfiction. Arguably it would hurt their brand more, but since it's marketed as unofficial merchandise I don't think they really care too much.
