Actually, Nintendo's system is so fucked that you basically get full games from Nintendo's online store itself with most piracy methods. They don't really have great authentication methods.

I know plenty of people who pirated Splatoon on the Wii U and could play it online no issue. The only thing Nintendo cares about in that regard is if you're messing with the game's code (white ink, playable octoling), not if your copy is "legit."

Can't wait to pirate Splatoon 2 in the near future, and since NFC spoofing is a thing, I can't wait to get all the amiibo benefits without coming off like a weaboo manchild who buys anime figurines.

3DS homebrew is risky because Nintendo still releases patches and banwaves out for it since they still see it as a viable source of profit until 2019 or 2020.

The 3DS selling less units than the DS is due to casuals drying up, not the core. Handheld appeal weakened across the board with the growth of mobile.
