Out of all the targets in the base game hes probably the most deserving candidate for getting spared with the only other potentially worthy non-lethal candidate being Hiram "Literally recorded my own confession" Burrows. Unlike a lot of the prior targets he accepts and understands that what he did was wrong and willingly allows himself to be punished for it. He drops you in an easy to escape cell instead of killing you knowing you posses similar abilities to him, he sends his guards away for a 1-on-1 duel, he lets you decide his fate when he loses despite being able to just blink away and his final speech(+extra pacifist dialogue) shows how broken he's been since the assassination.
