That's where I'm torn on this thing. I'm not sure that LPing a linear game would fall under fair use. Multiplayer games would. Games with many different outcomes and ways to play also would. But linear, story-driven games would fall into a very grey area that may weigh poorly against for-profit channels, and may not be protected by fair use. Movies are a bit different, because a movie is actually just the movie. A movie is not changed depending on who is watching it. A game IS changed by who is playing it. A movie + commentary can be separated as two distinct products, which is why people release commentary tracks for movies now (like RLM does). Some games clearly do fit under fair use but, it's because of how many different ways to play them and different outcomes you can have, etc., once you start to look at story-driven games you're likely to see an outcome more similar to books and movies, and it doesn't matter how funny the voice you performed for Harry is, you can't read Harry Potter online for money under current copyright law.
