The only time you get a penalty (a fine or just a bigger % of the transaction kept by PayPal) is if you don't respond in time.

TL;DR - Only lazy ass vendors who don't actually keep track of their PayPal wallets eat dispute fees. "Successful" streamers pay people to watch shit like this. The company I work for has three full time employees who's entire job is to respond to chargebacks / disputes across all major payment methods. It is the cost of doing business.

I respect very few streamers - mostly Reynad and Kripp. Kripp for being down to earth and as chill as possible.

Reynad for being cunning, fiercely intelligent and driven. I know it's gay to say, but the dude is 25 and is a CEO of a multi-million dollar company. He's one of my role models and I'm a year older than him.

He was able to use his streaming platform as a simple stepping stone to greater pastures. That's way more than your average manchild streamer like Reckful and Summit could ever achieve.

Fair use has clauses for educational purposes and reviews, but the first is invalidated in being monetized. Saying Let's Plays/streams are reviews are also iffy, because even movie reviews can't show the entirety of a non-public domain film without permission, which is why things like MST3K can't just throw up new movies, but rifftrax can let you sync it to a movie you own.

It hasn't come to it, that i'm aware of, but the entire streamer culture could collapse pretty easily if copyright holders decided to start enforcing them, the legal fees alone could fuck them over. You could probably get away with specific things, WoW, for example, hardly streams the entire experience, but when you stream a linear, story driven game? I could easily see that going to court.

No one seems to understand that putting up raw footage of a video game is still a legal grey area. Saying something is a donation, doesn't make it so. It's income. You are profiting from a copyrighted work. They report it as "income". They are not a non-profit organization, most streamers are actually LLC. They literally turn themselves into a company for legal purposes.

Even if you turn off all ads, if you accept money in return for a service, like creating/posting videos, you are profiting.

Now, it's theoretically possible you could have a non-profit educational or religious streamer, but such groups have to prove their status to the government, and if found illegitimate are charged back taxes and potentially fined or jailed.

But if let's plays are such an issue then most copyright holders certainly would have shut them down by now. In fact I'm pretty sure most companies that make these games like the advertisement. The only companies that really do try to shut down let's plays are Nintendo and Rockstar I believe.
Ultimately let's plays are illegal but so is Jay walking. It's a victimless crime.

Streamers dont have it easy bud. There's maybe 100 guys making a good living out of it and 10,000 delusional in debt struggling to eat every month. And it's not exploiting children, it's actively encouraging donations of parent's money. It's not a morality issue, it'a a legality / regulations problem. In a few years there will be rules against it I'm sure.
