Because it takes money and resources to go back and patch it out. Most of the development teams have moved on to new projects or been disbanded, so assets would have to be refocused to go back to an old game. And for what? Most normies don't even know Denuvo is there in the first place, so publishers aren't going to invest in returning to old games and removing it. Exactly the same as most didn't bother to go back and patch out other obsolete DRM, or Games for Windows Live.
