I don't think you can take the tomb as evidence, basically once a character disappears from the game they automatically are counted as dead and the mechanic kicks in.
Just like when you cast a control spell on a vampire then they die, the courier comes to give you their inheritance, because they were considered an ally, probably the same thing, Bethesda probably didn't even take that into consideration, it's just a mechanic playing itself out, in my opinion.

The actual character (As in their body) is moved to an off map death room. If you put yourself into it you find them naked, as well as how you left them, so if you cut off their head, they appear headless.
