but this problem could easily be solved by making him capable of only jumping and not flying

Play Kirby 64 and/or Air Ride off the air ride machines, in those games Kirby can be fly but not infinitely, he has a limit and will run out of air eventually. If they did this in a full fledged 3D game they could balance it out and not make it over powered.
