Disney LITERALLY owns all of these characters in every form of media except for live action films. Yes, Disney, if they want, could make a X-men video game or cartoon without having to pay anyone.
However, Disney doesn't want to actively promote any character they don't have movie rights to. Fox owns Fantastic Four and X-men movie rights. That's why they aren't in MvCi.

wrong. Fox only owns the Movie rights.
Ergo They won't make anything related to them until either Fox forks over the IP movie rights or their hold on the rights is over.
Disney can make an xmen game if it wants. They just won't because that would proxy be giving free advertising for Fox, not Disney.
