It's a complete cop-out since he falls about 200 feet into rocky water, but ND specifically programmed him to live so Drake wouldn't be responsible for killing an innocent museum guard.

The guards at the auction in 4 is pretty iffy though, the game explains everyone there is criminals, but killing some low level mafia thugs who were hired for security is still kinda morally shitty. The mansion the auction took place in was owned by someone and Nate/Sam/Sully wernt invited, so self defense doesn't hold up like it would in all the scenarios of running into bad guys in the wilderness or public places who starts shooting at you.
