FOX only owns the rights to them in movies. Marvel still owns them for games and other media. Hence why Wolvie, x-23, Mag-fucking-neto, storm, and the New York Knicks were in both MVC3 and UMVC3, and all the other marvel games.

They are literally just doing it to scorn Fox for holding on to those hot properties so they don't get money off of free publicity

The only rights they don't have are movies. ONLY movies. That is it. Completely. Everything else has to go through Marvel and Disney. This includes and is not limited to: toys, games, posters, books, comics, LITERALLY EVERYTHING THAT IS NOT MOVIES. Why do you think we don't get any Fox movie tie-ins anymore? Hell, we don't get X-men games period, not since X-men Destiny. The X-men have been under a media embargo by their own fucking company until recently, thanks to some in-house drama.

Unfortunately, MvC Infinite was in development during the embargo. Not that it would have changed much, since this game is clearly a fucking disgrace.
