This isn't even a case of correlation not implying causation as there's no correlation between Spotpass and the bans to begin with. Having Spotpass off doesn't prevent a ban just the same way as having it on doesn't mean you get banned.
The two seemingly are unrelated.

I know because I had my Spotpass on the entire time before, during, and after the banwave and Big Brother Nintendo never banned my B9S+Luma 11.4 3DS even though I save edited, used freeshop, and cheated online.

There's a reason no one can figure out what causes or prevents the bans anon. They seem almost entirely random. Either by design or by Nintendo's incompetence, people who've done almost nothing and took (almost) every precaution were instantly banned while others were completely obvious about everything and are still unbanned.
