You're just not paying attention. 10 S is going to be so locked down it won't even let you install Chrome, or use Google as your search engine.
Once its on the majority of new systems companies will start only distributing UWPs, and may include checks that require the locked down mode even if you've 'upgraded'.
The locked down mode is already present in Windows 10, the only difference is on 10 S you'll have to pay to remove it.

The problem there is that Microsoft isn't a not for profit organization whose goal is to build a better OS.
They're a for profit company whose only goal is to maximize shareholder value by continually making more money than they have before.

In a world where they already basically control their market, other markets are held by established players with better products, and the price of devices keeps tumbling down the only way for Microsoft to make more money is to shift the costs from the OEMs to the end users, and extract more money from those users directly.

There's already win32 compatibility software and in the not too distant future you'll be running your win32 stuff wrapped with it much like you run your DOS stuff with DOSbox.

Even if a future administration takes them to court their competitors will be dead, hollowed out companies with only legal departments left, or so crippled from years of making very little money they'll be no real threat.

windows 10 does spy on you with things like MarkMonitor, which sends a hash of every image you open to them, as well as many other things that are just as shit, if you don't believe it, fire up windows 10 in a VM, MITM yourself with a systemwide cert and decrypt all the traffic through wireshark and you can clearly see that their "telemetry" has nothing to do with the OS itself and everything to do with what you're doing on it. if the spying wasn't real, there wouldn't be tools to try and stem the leakage of data (Destroy-Windows-10-Spying, Shutup10, and so on).
