It's a Japanese company. Not every country is familiar with every other countries gestures. Especially when they mean different things in different counties. You can't go around asking if every single gesture in your game could be offensive in another country as there aren't representatives from every country working on every Nintendo game. And to assume that your country's way of reading a gesture is the only way to read it is just ignorant.

My argument was that he WASN'T doing the peace sign but in fact the up yours sign as they are easy to mix up. So no there is no flaw in that. I said the hand looked correct in the picture but when he actually does it, it looks like a he turns his hand around. Even if the fingers are placed correct the gesture indicates he's using his back of his hand not his front... Or so I thought. I looked up a video and it appears it's been too long since I last played SM64. My mistake. I apologize.
