Stuff like this isn't released to retail so it usually is still under contract and was probably meant to be chucked.

If word reached Bliz about the code, they would have either ran the cops on the guy (as Apple did when their iPad prototype turned up in the wild) or opensource the '98 code out of spite to ruin the value.

You can't do anything with unlicensed commercial code anyhow. It would serve little more than novelty factor. The engine that powered this game wasn't anything to get excited over either. The game has been hacked to shit times over anyhow.

The guy could have just stuck it in his basement to rot, but that wouldn't be any better than its previous fate.

Unless he posted something that could link him to that specific sourcecode (i.e. a serial number specific to it), which he didn't, he could have posted everything on Reddit then uploaded it via Tor and all Blizzard could do nothing but sue him on no grounds and get the case thrown out by the judge.
