Blizzard would have to demonstrate the disk was stolen to have any claim over it, And given the shithow that went down throughout the history of Blizzard, there's a good chance the employee who took the disk was legally allowed to do so.

At that point it would be illegal to distribute the code (that would violate copyright) but there's nothing illegal about selling/buying/keeping it.

Long story short, the source code could have either contained alpha/beta elements of the game that are worth looking at for archival or history purposes as well as allowing modders to create modifications for Starcraft, custom fixes, or just straight up mods.

As someone who is big into preserving and archiving alpha/beta software, fuck this guy hard for what he did. The Japanese were notorious about source code getting lost. I believe Konami actually printed its souce code on paper for several games for some reason, or just plain out delete it and move on.

Sega also went through a lot of shit back in the late 90s and early 2000s and was not a healthy company. Their policies were all over the place, and data archival was probably not their highest priority.

Not really, games like the classic Mega Man were coded close to the hardware so you can use tools like LLVM to decompile the ROM, and convert the code into something human readable and that can be easily compiled for a modern GNU/Linux based OS.

Its not. There are a bunch of ways to know if somebody is using your source code without authorization if you have reason to suspect its going on. Lawyers and technical experts for companies built on open source deal with this stuff all the time.

One method is to use 'strings' to compare the results between two compiled binaries. You might think that people who take source would be evil geniuses who would take the basic step of removing comments and changing other strings but they usually don't.

Another method is to run software to strip those kinds of obvious signs, then run the modified source through a variety of compilers and compare the results.

Now that's not going to be enough generally to win in court, but it can be enough to get into court or get a settlement.

People had 20 years to make an open version of it, all they had to do was to care enough. Much more complicated games have been rewritten from scratch with nothing but decrypted resources and experience with the game as references in much shorter time.

Now, 3 is indeed great, but unless you want to play it in your watch there isn't that much reason to care about it. The game plays fine in modern systems.
