If an update accidentally bricks 3DS users who play Stormbreaker(DSTwo flash cart) then yes nintendo will put forth good will.

If an update accidentally bricks Gateway/Any other dedicated 3DS flashcart, then nintendo could care less.

If homebrew/piracy are based around mistakes in the code, then a mistake that bricks consoles is possible if the flashcart is abusing those mistakes

The only currently working way to pirate 3DS games is using a flashcard (Gateway) that only works on 4.0-4.5 firmware consoles (which are getting progressively rarer).
There's a softmod that works on updated consoles coming out later this month, but by itself it doesn't allow piracy, so if it actually gives us a way to pirate games we'll have to wait months before there's a practical way to do so.

I don't own a Gateway either, but you should be able to access the eShop and download the updates by spoofing the newest firmware version through emuNAND. I think it's not working right now due to the eShop's encryption key being updated as well, but once they fix that it shouldn't be a problem anymore.

The DS is the only console of the ones you mentioned that might have been affected by piracy, and even then it never completely died before support naturally slowed down in the last 2 years of its life.
