Higuchi admitted it at G-Fest. A live-action Japanese Godzilla cannot be made while a Legendary film is in active production. Godzilla 2 and Godzilla vs King Kong fills the schedule until 2020. He didn't mention the animated films, so I assume that wasn't part of the contract and Toho exploited it.
